Celebrity Justice
Miley Cyrus: Actress, Pop Star, Defendant

OMG! Hannah Montana is being sued by a fan! The charge facing tween star Miley Cyrus? Failure to make tickets available to upcoming concerts. Oh, what-ever!

Kerry Inman of Pennsville, New Jersey says she paid $29.95 to Cyrus' official website, MileyWorld.com, which promised to make seats available to members before they went on sale to the general public.

The $5 million class action lawsuit filed in Tennessee alleges that Interactive Media Marketing and Smiley Miley, Inc. were "unfair and deceptive" and "created a false impression that tickets would be available."

Clearly, there'll be no backstage passes for her!

UPDATE
: Miley's rep issued the following statement to TMZ: "Among the many benefits of membership, Mileyworld members had an opportunity to purchase pre-sale tickets to the Hannah Montana & Miley Cyrus: Best of Both Worlds concert tour and more than 70,000 Mileyworld members obtained concert tickets as a result of their membership in Mileyworld. The Mileyworld website expressly states that Mileyworld does not guarantee every member a concert ticket. Mileyworld members had far greater access to concert tickets than the general public and other fan clubs and the claim that the vast majority of Mileyworld members were unable to obtain concert tickets is simply false. Mileyworld will vigorously defend itself from the frivolous claims in the lawsuit."

32. why don't they limit the tickets to 5 or so per person. The online brokers and hackers wouldn't be able to hoard all the tickets to miley's concerts, that way

34. The ticket scam, what a brillant publicity ploy.

Too bad so many children had their feelings hurt. I hope they realize what she did for publicity and find another star to follow.

37. The girl paid for a membership, not tickets. Her parents surely read the agreement of the membership before they brought forth such a lawsuit. Sounds like they are spoiling her. I do think it stinks how corporations scarf up the tickets then girls end up paying $1000 to see a 14 yr old. If idiotic parents weren't paying that $1000 plus it wouldn't be happening! Altho Miley owes this girl nothing she should do something about the way her tickets are distributed so her fans could afford the tickets. Perhaps she needs to give a couple concerts where only 50 buy tickets? I took 4 girls to see "New Kids on the Block" years ago for 7.50 each. If some scalper upped the tickets to $250 those girls would not have been at the concert. Too many sheep out there acting like fools and paying stupid prices for a concert.

39. First of all I can't believe people would pay $29.95 to be a member. You are all a bunch of losers. Miley Cyrus, this is friggin funny. What a bunch of pathetic children you all are. How old is everyone here, 12??????. People this is pathetic tween pop music. She is a prefab nobody. Did you know at $29.95 x 70,000 people that are members, losers paid 2.1 million dollars for a membership to a nobody. Listen to real music people, no prefab pop crap.

42. There is another side to this story which everyone seems to be missing. When originally launched the web site did NOT state any of the details regarding ticket sales, only that MileyWorld members would have access to tickets days before they went on sale to the general public. The wording gave members the impression that all of the tickets in the venue would be made available to members first and if there were any left, they would go on sale to the general public. Additionally, the ability to purchase tickets was a very heavily advertized benefit of joining the site. Obviously, they have since changed the wording on the site, so anyone checking now would think the lawsuit is frivilous. Not so.

It's called false advertizing. The reason it's a 5 million dollar lawsuit over a $29.99 membership is because it's a class action lawsuit, meaning anyone affected who files a claim will gain a portion of the proceeds, not just the one individual filing the lawsuit.

My 10 year-old joined Miley World when it launched in May; saved her allowance for 6 weeks to do so. (Yes, my 10 year-old gets $5.00 a week allowance for bathing the dog, helping twith the vacuuming, and assisting me with laundry. This is hardly the spoiled rotten variety of kid that everyone responding seems to believe was the only one affected by the situation.) Another perk of membership is a member packet, consisting of a member card, wristband and various other trinkets. Six months have passed and we have yet to receive anything besides promises, despite 3 complaints through the site, a phone call to the number listed on my credit card statement and a complaint with the BBB. A quick log on to the chat room last week revealed that many other members are having the same problem. getting their member packets as well.

We did get tickets to last Sunday's show. I entered, "any price" and "best available" and got 4 tickets in the nosebleed section that cost about $50.00 each. The three10 year-olds I took to the show were afraid to be so high up in the stadium with very steep steps to get to the seats. Although Miley said the only rule at her concert was that everyone should be up dancing, they didn't stand up or leave their seats once - not until it was time to go. Four after I purchased my tickets the general public tickets went on sale, and then the floor seats became available. My "priority status" purchase was nothing more than a gimmic and a rip-off.

Bottom line, Miley Cyrus's fan club and web site are poorly run. Although 14 year-old Miley does not run the site personally, she is involved in it's conception, with recorded video spots pushing kids repeatedly to join because of all of the "exclusive" benefits they'll receive. She endorses the site and it seems many aren't getting what they paid for.
